Cave Family Land Deeds

These are transcriptions of land deeds involving members of the Cave family, primarily in Fauquier and Stafford Counties, VA. Additional deeds in this series may be accessed below. Many thanks are owed to Alice Owens for the transcriptions from microfilm.

John Cave to Richard Luckett (1823)

This Indenture made this 26th day of May in this the year of our Lord one thousand eight hundred and twenty three, between John Cave of the county of Fauquier and state of Virginia, of the one part and Richard Luckett of the same county and state aforesaid of the other part ----Witnesseth, that the said John Cave in order to secure the payment of the following debts (Viz) the sum of fifty dollars with the interest thereon or before the 26th of September one thousand eight hundred and twenty five to Elizabeth Rally of said County due by Bond to her and in consideration of the sum of one dollar to him in hand paid the receipt whereof is hereby acknowledged at or before the ensealing and delivery of these presents by the said Richard Luckett. We the said John Cave hath granted bargained and sold and by these presents doth grant bargain and sell unto the said Richard Luckett twenty five acres of land situate, lying and being in the county of Fauquier and adjoining the lands of Elizabeth Raly and R. Smallwood and the reversion and reversions remainder and remainders, yearly and other rents, issues and profits thereof and of every part and parcel thereof, and also all the state, right, title, interest, trust, property, claim and demand whatsoever both at Law and in equity of him the said John Cave into or out of the said lands, tenements, hereditaments and premises To have and to hold the said twenty five acres of land herein before mentioned to be hereby granted with all and singular every of its appurtenances unto the said Richard Luckett his heirs, Exors, & admrs.. and assigns forever. Upon trust never the less that the said Richard Luckett shall as soon as conveniently he can after having advertised the time and place and place of the sale before mentioned in some public newspaper published nearest to the residence of said John Cave for one months proceed to sell the same to the highest bidder for the best price that can be obtained and out of the monies arising from the sale, in the first place to pay and satisfy all [attainable] charges [attending] such sale and then the debt to Elizabeth Raley before mentioned, and the residue of the monies arising from such sale as aforesaid to the use of the said John Cave his exec. admrs., or assigns or to such person or persons as he by his writing under his hand shall appoint and in default of such appointment to such person aforesaid as to be thereto entitled by virtue of the statute for distribution of intestate estates.

We Joseph Blackwell and William R. Smith Justices of the peace in the county aforesaid in the state of Virginia do hereby Certify that John Cave party to a certain deed bearing date the 26th day of May 1823 and hereto annexed personally appeared before us in our County aforesaid and acknowledged the same to be his act and Deed, and desired us to Certify the said acknowledgment to the Clerk of the County in order that the said deed maybe recorded, Given under our hands this the 26th day of May 1823.

This Indenture made this 26th day of May in the year of our Lord one thousand eight hundred and twenty three Between John Cave of the County of Fauquier & state of Virginia of the one part and David Wickliff Jr of the same County and state aforesaid of the other part Witnesseth, that the said John Cave in order to secure the payment of the following debts, Viz that the sum of sixty dollars with the interest thereon and costs that may accrue on or before the the 26th May [next] to Sarah L. Combs of said County due by Bond, and Richard Luckett security [on] said Bond, and in consideration of the sum of one Dollar to him in hand the receipt whereof is hereby acknowledged at or before the ensealing and delivery of these presents by the he said David Wickliff, Sr. to the said John Cave hath granted bargained and sold and by these presents doth grant, bargain, and sell unto the said David Wickliff, JR thirty acres of land situate, lying and being in the county of Fauquier and adjoining the lands of Richard Luckett and Elizabeth Raley, and the reversion and reversions and remainder and remainders yearly and other rents issues and profits thereof, and of every part and parcel thereof, and also all the estate, right, title, interest, trust, property, claim and demand whatsover both at law and in equity of him the said John Cave, in to or out of the said lands, tenements or hereditaments and premised, To have and to hold the said thirty acres of land herein before mentioned to be hereby granted with all and every of its appurtenances, unto the said David Wickliff, Jr his heirs, Exc., admrs.., and assigns forever, Upon Trust never the less that he said David Wickliff Jr. shall as soon as conveniently he can after having advertised the time and place of the sale of the land before mentioned [xxx?] in some public newspaper published nearest to the residence of John Cave one month proceed to sell the same to the highest bidder for the best price that can be claimed, and out of the monies arising from the sale, in the first place to pay and satisfy [xxxable] charges attending such sale and then the debt
